Heard Sri Madhusudan Dixit, learned counsel for the petitioner and Sri C.K. Parekh, learned Senior Advocate assisted by Sri Vivek Mishra, learned counsel for respondent no.2.
The grievance raised by the petitioner is that in spite of duly sanctioned map by the competent authority for the construction in question the respondent Nagar Nigam men have come up on the spot and put mark and the exercise of demolition may be carried out by the Nagar Nigam pursuant thereto.
Learned Senior Advocate Sri C.P. Parekh has apprised the Court that the Nagar Nigam has nothing to do with the construction in question involved in the present writ petition and no marking has been done by the men of Nagar Nigam.
In such view of the matter, therefore, and the statement as has come up from the learned Senior Advocate, the very ground raised in the writ petition that the Nagar Nigam is involved in the exercise of proposed demolition is absolutely untaneable.
The petitioner may approach appropriate authority if he has any grievance and if he is aggrieved with those who are involved in the matter.
In view of the above writ petition is consigned to records.
