Atul Kumar Gupta vs Union Of India And Others

High Court Of Judicature at Allahabad|22 August, 2019

JUDGMENT / ORDER

Court No. - 1
Case :- WRIT - C No. - 27580 of 2019 Petitioner :- Atul Kumar Gupta Respondent :- Union Of India And 3 Others Counsel for Petitioner :- Sanjay Maurya,Deepak Kumar Jaiswal Counsel for Respondent :- A.S.G.I.,Vikas Budhwar
Hon'ble Ramesh Sinha,J. Hon'ble Ajit Kumar,J.
Supplementary affidavit filed today is taken on record.
Heard Sri Sanjay Maurya, learned counsel for the petitioner and Sri Vikas Budhwar for respondents.
The argument of learned counsel for the petitioner is that apart from the plot no. 1416 Minjumla, the petitioner had also purchased plot no. 1414/A to the measurement of 1180 square meters and that has been directed to be also included to his Khata no. 215 and hence the argument is that both the plots should be taken as one plot offered under the application pursuant to the advertisement in question.
In our considered opinion, the argument is clearly misplaced. The Khata number and Khasra number cannot be diluted with each other. Every tenure holder has a single Khata number with different Khasra numbers and it is not the case that petitioner had given Khata number as an offer of land, and, therefore, we are not impressed by the argument advanced by the learned counsel for the petitioner.
Dismissed.
