Heard learned counsel for the applicants, Sri I.P. Srivastava,the learned A.G.A. for the State and perused the record.
The instant bail application has been moved seeking anticipatory bail in light of the apprehension of the arrest of the applicants in Case Crime No. 1761 of 2019, under Sections 406, 471, 467, 468, 420 I.P.C., Police Station Shahibabad, District- Ghaziabad.
The Court finds itself unable to countenance the prayer for anticipatory bail bearing in mind the fact that the allegations which have been levelled are not disputed in the application. The principal allegations are that the hospital with whom the applicant's company had an outsourcing contract was overcharged by fabrication of documents. Learned A.G.A. additionally apprises the Court that despite notices having been issued under Section 91 Cr.P.C., the applicant has not produced the relevant documents and has not cooperated in the investigation.
Consequently, the prayer for anticipatory bail is refused. The Application is consequently rejected.
