Heard learned counsel for the petitioner; the learned A.G.A. for the respondents 1 to 4; and perused the record.
The instant petition seeks quashing of the show cause notice dated 11.04.2019 issued under Section 3(1) of U.P. Control of Goondas Act, 1970 on the ground that it places reliance only on a solitary case and therefore the petitioner cannot be said to be a Goonda.
From a perusal of the notice, it appears that reliance has also been placed on Beet Information No. 36.
Under the circumstances, the appropriate course for the petitioner is to submit a response to the notice, if not already submitted. In case, response to the notice has already been submitted then the petitioner may pursue the response and contest the proceedings.
