The present 482, Cr.P.C. application has been filed to quash the entire criminal proceedings of Case No.3981 of 2018, arising out of Case Crime No.811 of 2018, under Sections 323, 504, 506, 308, IPC as well as charge sheet No.697 of 2018 dated 26.7.2018, P.S. Baghpat, District Baghpat.
The argument is that the order of cognizance dated 29.8.2018 has been passed in a cyclostyle form without application of mind.
A perusal of the order shows that the argument of the learned counsel for the applicant is correct.
In view of above, order dated 29.8.2018 passed by the court below is, hereby, quashed.
It is open for the court below to pass a fresh order in accordance with law.
The application is allowed.
