Heard learned advocate Mr.P.S.Gogia on behalf of petitioner and learned advocate Mr.R.P.Mankad on behalf of respondent. I have considered submissions made by both the learned advocates. Ad-interim relief in terms of Para-6(b) on condition that petitioner shall have to comply with the provisions of Section 17-B of the Industrial Disputes Act, 1947 from the date of award i.e. 19.12.2009.
Notice as to interim relief, returnable on 16.06.2010.
However, considering the facts, which found from the record that there is no allegation or misconduct alleged against workman. Therefore, during pendency of this petition, it is open for the petitioner to consider the case of workman for reinstatement. However, it is open for both the parties, if there is possibility of settlement, to make some efforts for settlement.
