Petitioner is before this Court with a prayer to issue a writ, order or direction in the nature of mandamus commanding the respondent no. 2 and 3 to comply the status quo order dated 2.7.2011 passed by Civil Judge (J.D.) Sharki, Allahabad in Civil Suit No. 983 of 2011 (Asharfi Lal Vs. Sangeeta Tripathi and others). Further prayer is to issue a mandamus commanding the respondent no. 1 to decide the stay extension application dated 02.07.2018 as well as the aforesaid Suit.
Sri Jitendra Kumar Yadav, learned counsel for the petitioner very fairly states that so far as inadvertently first relief has been asked for and as such he is not pressing the same but at the same time he requests that status quo order dated 2.7.2011 which has been accorded by Civil Judge (J.D.) Sharki, Allahabad in Civil Suit No. 983 of 2011 (Asharfi Lal Vs. Sangeeta Tripathi and others), he has moved an application dated 2.7.2018 for extension of the said interim order and the same is pending consideration and as such, he is pressing only the second relief.
Heard learned counsel for the petitioner.
In the facts and circumstances, without adverting on the merits of the case, the writ petition stands disposed of asking the Civil Judge (J.D.) Sharki, Allahabad to decide the stay extension application pending in aforesaid Suit,in accordance with law, as expeditiously as possible and preferably within three months from the date of production of certified copy of this order certainly after affording opportunity of hearing to the second and third respondent, without granting unnecessary adjournment to either of the parties, except upon payment of cost.
