The appellant had claimed compassionate appointment on the death of his brother who was working as a Safai Karmi. His brother was unmarried and after his death, the deceased left behind his mother aged about 80 years and the appellant who was then aged about 35 years. It is stated that both the appellant and his mother were dependant on the deceased employee. It is further stated that after the death of his brother, the appellant married.
We, therefore, find it difficult to believe that three members namely the mother, the brother and his wife have been maintaining themselves. The learned Judge has also observed that there is nothing on the record to show that petitioner was dependant on his brother.
Learned counsel for the appellant prays for and is granted one month's time to file an affidavit to bring on record the correct facts.
