JUDGMENT / ORDER

[1] By way of this petition, the petitioner has made following prayer : -
"13(A). Your Lordship be pleased to issue a writ of prohibition or a writ in the nature of prohibition or any other appropriate writ order and or direction, quashing and setting aside the order of preventive detention a pre-execution stage passed by the respondents, declaring the same to be illegal, invalid, null and void and arbitrary."
[2] Today when the matter is called out, learned AGP has placed on record affidavit-in-reply which is directed to be taken on record. Para- 4 of the said affidavit reads as under :-
"4. ...I Say that as on date, neither any proposal was prepared by me in the above matter nor any detention order was passed by the detaining authority to detain the petitioner under PASA and as such the present petition filed by the petitioner invoking the extra ordinary jurisdiction of this Hon'ble Court under Article 226 of the Constitution of India praying therein for quashing and setting aside the alleged threatening action of respondent nos.2 and 3 of passing the order of detention under PASA Act against the petitioner and as such the present petition is liable to be dismissed by this Hon'ble Court...."
[3] In view of above, learned advocate for the petitioner does not press present petition at this stage. Petition stands disposed of as not pressed. Notice discharged.
