The petitioner has challenged the notice dated 1.5.2019 and 4.6.2019 issued by Barielly Development Authority, Barielly.
In paragraph 14 of the writ petition the petitioner has averred that he has submitted a reply to the show cause notice on 1.8.2019, the same is pending consideration.
We have heard learned counsel for the petitioner, learned Standing Counsel and Mr. A. N. Dubey, learned counsel appearing for the respondent Nos. 2 and 3.
It is trite law that writ petition against the show cause notice is not maintainable except on the limited grounds amongst others. It is not the case of the petitioner that the authority concerned has no jurisdiction to issue the notice. Accordingly, we do not find it appropriate to entertain the writ petition at this stage.
However, having due regard to the facts of the case, as the petitioner has submitted reply to the notice, we direct the respondent to pass appropriate order expeditiously preferably within two months.
Needless to say, we have not expressed our opinion on the merits of the case. The authority concerned shall pass appropriate order independently in accordance with law.
