This writ petition has been filed by the petitioner with a limited prayer for a mandamus to the Appellate Authority to decide the Stay Application of the petitioner pending before him since 8.1.2018. In the Appeal filed by the petitioner challenging the cancellation order, namely Appeal No. C2018170000000033 (Ashok Kumar Vs. SDM, Bhanpur, Basti).
Accordingly, without entering into the merits of the controversy, this writ petition is disposed of with a direction to the Appellate Authority to decide the Stay Application of the petitioner within two weeks from the date a certified copy of this order is produced before him.
The Appellate Authority shall thereafter make an effort to decide itself on merits within the time prescribed under the U.P. Essential Commodities (Regulation of Sale and Distribution Control) Order, 2016 within sixty day.
