Heard Mr. A.P. Singh, learned counsel for petitioner and learned Standing counsel for the State respondent.
The present writ petition under Article 226 of the Constitution of India has been filed for direction to competent authority, to conclude the proceedings under Section 3/5 of Public Premises (Eviction of Unauthorized Occupants) Act, 1972,within the stipulated period of time.
It is submitted by learned counsel for petitioner that the case of the petitioner registered as Case No. 06166/2019. Notice was issued on 11.9.2019 to opposite party fixing 27.9.2019 but till date noting has been done.
Learned Standing Counsel submits that no useful purpose would be served in keeping the writ petition pending and an appropriate direction may be issued to respondent no. 2- SDM, Tamkuhi, District Kushi Nagar, to consider the grievance of the petitioner.
Considering the facts and circumstances of the case, without going into the merit of the case and with the consent of the parties, the writ petition is disposed of with a direction to respondent no. 2- SDM, Tamkuhi, District Kushi Nagar, to decide the claim of the petitioner as expeditiously as possible in accordance with law.
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall act accordingly without waiting for submission of the certified copy of this order.
