Heard learned counsel for the petitioners.
In view of the order proposed to be passed, notices need not go to the respondents.
The plaintiff-petitioners are before this Court for a direction to Addl. Civil Judge (JD) Court No.8, Allahabad to decide Contempt Case No.75 of 2017 (Ashok Kumar & Ors. v. Ram Chander & Ors.) filed under Order XXXIX Rule 2A of CPC in Original Suit No.2419 of 2017 (Ashok Kumar & Ors. v. Ram Chander & Ors.) within stipulated period.
Considering the facts and circumstances of the case and without expressing any opinion on the merits of the issue, the writ petition stands disposed of finally with a direction to Addl. Civil Judge to consider and decide the aforesaid contempt case in accordance with law expeditiously but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, except upon payment of cost.
