Heard Ms. Shruti Taneja, learned counsel for the petitioner.
The present writ petition has been filed seeking following relief:
"(i) to issue an order or direction to the Additional District Judge-21, Allahabad to decide the SCC Suit No. 3 of 2019, Ashok Kumar Singh Vs. Prabhu Shankar Shukla within time as specified by this Hon'ble Court."
It is submitted that the petitioner filed a suit against the respondent for arrears of rent and eviction, registered as SCC Suit No. 03 of 2019 (Ashok Kumar Singh Vs. Prabhu Shankar Shukla). It is further submitted that the court below issued summons to the respondent on 15.02.2019 and thereafter the case is pending consideration before the court below.
Perused the order-sheet as well as the report of the Addl. District and Sessions Judge, Court No.21, Allahabad dated 15.09.2021. As per the report of the court concerned the respondent has appeared and is contesting the proceedings.
Expeditious disposal of a case is the right of every litigant and it is expected from every court to endeavour to dispose of a case pending before it, expeditiously.
Having regard to the facts and circumstances of the case, the present writ petition is disposed of with a direction to the court below to make every endeavour to decide the aforesaid case expeditiously, in accordance with law, without granting unnecessary adjournment to either of the parties, provided there is no other legal impediment.
