Heard learned counsel for the petitioner and Shri Amresh Singh for the Gaon Sabha as also learned Standing counsel for the State-respondents.
By means of this writ petition, petitioner has challenged the order dated 04.05.2019 passed by the Tehsildar in a mutation case as also the order dated 06.07.2019 passed by the Additional Commissioner (Administration), Bareilly, whereby the consequential revision has been dismissed.
Since, the writ petition arises out of summary mutation proceedings, which do not determine the title of the parties, thereto and the orders passed therein have purely fiscal connotations, this Court does not consider it expedient to interfere in the matter.
The petitioner, in case so advised, can always sue for a declaration in his favour, as the findings returned in the proceedings for mutation do not bind the Courts in regular title proceedings.
Subject to the above, this writ petition is dismissed.
