Heard learned counsel for the petitioner and learned Standing counsel for the State-respondents.
The petition has been filed seeking the following relief-
"I) issue a writ, order or direction in the nature of mandamus commanding the respondent no.2, Naib Tehsildar, Dudhahi, Tehsil Tamkuhiraj, District Kushinagar to consider and decide Mutation Case No.1170 of 2003 (Ashad Ali Vs. Haseena Begum) under Section 34 of Land Revenue Act, 1901 is pending since 27.04.2005, within short stipulated time to be fixed by this Hon'ble Court."
It has been stated that a mutation case filed by the petitioner in the year 2013 has not been decided finally till date.
Under the circumstances, this writ petition is disposed of directing the respondent no.2, Naib Tehsildar, Dudhahi, Tehsil Tamkuhiraj, District Kushinagar to endeavour to decide the mutation case of the petitioner, expeditiously, preferably within a period of three months from the date a certified copy of this order is filed before him.
