The suit in O.S.No.94 of 2016 is filed by the revision petitioners/plaintiffs for partition. Along with the said suit, I.A.No.227 of 2016 has been filed under Order 39 Rules 1 and 2 of CPC for interim injunction restraining the defendants from disturbing the peaceful possession and enjoyment and cultivation of the plaintiffs' share in the land. Though the suit is filed in May 2016, as there is no Presiding Officer in Chidambaram, it has been adjourned from time to time. Learned counsel for the revision petitioners states that the suit is now posted for hearing on 13.02.2017. The suit is pending on the file of the Principal Sub-Court, Chidambaram. As there is no Presiding Officer in Chidambaram, the Principal Sub-Judge, Cuddalore, who is in-charge of the Principal Sub-Court, Chidambaram, is taking up the matters only on one day. The request of the petitioners is that in the absence of any restraint order, the defendants high-handedly destroy the paddy field in the suit property. Hence, the revision petitioners seek for a direction for speedy disposal of the said I.A. As it is stated that the suit is posted on 13.02.2017 and the other side has also been served with summons, the learned Principal Sub-Judge, Cuddalore, who is in-charge of Principal Sub-Court, Chidambaram, is directed to dispose of I.A.No.227 of 2016 in O.S.No.94 of 2016, within a period of three weeks from the date of receipt of a copy of this order. With this direction, the Civil Revision Petition is disposed of. No costs.
