Heard learned counsel for the applicant, the learned A.G.A. and perused the record.
This bail application has been filed on behalf of the applicant involved in Case Crime No.23 of 2015 under sections 302, 307/34, 504 I.P.C. PS. Bilaspur, District Rampur.
As per prosecution case three nominated accused persons including the applicant have been assigned the role of firearm injuries; deceased succumbed to injuries; postmortem examination report shows gun-shot injuries on the body of the deceased; eyewitness account supports the prosecution version; assault weapon has been recovered on pointing out of the applicant.
Learned A.G.A. has opposed the prayer for bail submitting that applicant is one of the main accused in the present case, it will not be in public interest in case he is released on bail.
Considering the facts and circumstances of the case, I am not inclined to allow the bail application.
The bail application is, accordingly, rejected.
The trial court is directed to expedite the trial and conclude the same expeditiously on day to day basis from the date of production of a certified copy of this order provided there is no other impediment.
Office is directed to send a certified copy of this order to the trial court concerned for immediate compliance.
