In this case, interim order was passed on 19.7.2006 staying the further proceedings of complaint case No. 617 of 2005 under Sections 147, 323, 504, 506 IPC pending in the Court of Additional Chief Judicial Magistrate-II, Mirzapur, District Mirzapur till the next date of listing.
It appears that the case was not listed since then and the interim order has not been extended on any date.
On 28.3.2018, the Apex Court in the case of Asian Resurfacing of Road Agency Pvt. Ltd and others vs. Central Bureau of Investigation; AIR 2018 SC 2039 has directed that in all pending cases where stay against proceedings of a civil or criminal trial is operating, the same will come to an end on expiry of six months from today unless in an exceptional case by a speaking order such stay is extended. In the present case, the interim order was not extended and it stands vacated.
In view of above, the present application u/s 482 Cr.P.C. is dismissed for the want of prosecution.
