The Registrar General of this Court has submitted his report dated 12.9.2018 today in the Chamber in compliance of the order of this Court 7.9.2018 annexing the explanation of Sri Satish Chandra-Section Officer (Stamp Reporting Section) and Rupesh Yadav-Review Officer (Stamp Reporting Section) and also of Sri Shiv Naresh-Oath Commissioner, who has attested the affidavit filed in support of the present petition.
After perusing the said report of the Registrar General and the explanation given by the said Officials, this Court is of the view that the same appears to be lame excuse as the Court is coming across on several occasions that casual approach is being adopted by the Officials of Stamp Reporting Section while reporting the petitions and application and by the Oath Commissioner while attesting the affidavit filed along with the same and when they are taken to task, a routine explanation is being given by them that such mistakes are without any intention and has occurred due to inadvertence on account of pressure of work. The Court express its displeasure about the explanation given by them. The explanation given by them is not at all convincing.
The Stamp Reporting Section as well as the Oath Commissioner are put to strict caution that if any such mistake is occurred in future while reporting the petitions/application, the Court will be compelled to take strict actions against them and disciplinary proceedings will be initiated against the erring official and if, in future, such casual approach of the Oath Commissioner while attesting the affidavits filed in the petitions/applications before the Court, is found, the licence of the erring Oath Commissioner will be cancelled.
The Registrar General of this Court is directed to serve copy of this order to the concerned Officer of the Stamp Reporting Section and also to all the Oath Commissioner of this Court.
