1. Sri H.N. Singh, learned counsel appearing for Gaon Sabha, on instruction, submits that in case petitioner informs about the alleged encroachment in writing within a week from today, the Respondent-5 shall take appropriate decision to initiate proceedings under U.P. Revenue Code, 2006 within three weeks thereafter, considering the judgment passed by this Court in Writ C No. 9195 of 2021 (Gaon Sabha Gram Panchayat Mauja Mugarsan Parganamah Tehsil Hadiya vs. State of U.P. and others), decided on 10th August, 2021.
2. Learned counsel for petitioner has no objection if the writ petition is decided in terms of above statement.
3. In view thereof, the writ petition stands disposed of in terms of the statement given by learned counsel appearing for Gaon Sabha concerned.
