1. Heard Sri R.V. Pandey, learned Counsel for petitioner, Sri Ram Babu Yadav, learned counsel for the respondent no. 3 and learned Standing Counsel for State-respondents.
2. Petitioner has already pursuing remedy in Original Suit No. 644 of 2016 pending in Court of Civil Judge (Junior Division), District Sant Ravidas Nagar, Bhadohi Gyanpur. Dispute raised in this petition is for same cause of action, therefore, petitioner shall not be permitted to pursue the case simultaneously in writ jurisdiction.
4. The writ petition is thoroughly misconceived and is, accordingly, dismissed with cost of Rs.5000/-.
