This Writ Petition has been filed, seeking a direction to the respondents to consider the Petitioner with disability(60%) for transfer to the vacant post of Noon Meal Organizer at Government Higher Secondary School, Maravamangalam, Sivagangai District from Panchayat Union Primary School, Kundakudai, Sivagangai District within the time stipulated by this Court.
2.Mr.M.Rajarajan,learned Government Advocate takes notice for the respondents. By consent of both parties, the Writ Petition itself is taken up for final disposal at the admission stage itself.
3.The case of the Petitioner is that she was appointed as Noon Meal Organizer in panchayat Union Primary Schol, Kundakudai, Sivagangai District in the year 1995 While so,she was given additional charge of Noon Meal Organizer of Government Higher Secondary School, Maravamangalam, Sivagangai District by proceedings, dated 31.8.2015. She would further submit that she was a person with 60% disability travelling with the help of three wheeler and hence she requested for transfer to Maravamangalam Government Higher Secondary school. In this regard, she has also submitted a representation dated 20.11.2015. Pursuant to the representation, dated 20.11.2015, the Petitioner was for an enquiry by the first respondent/District Collector,Sivagangai by communication, dated 25.11.2015. After enquiry, as there was no further progress, she made another representation dated 24.2.2016. Since the said representations did not evoke any response, the Petitioner has come forward with the present Writ Petition.
4. The counsel for the respondents would submit that it is agreeable for the respondents to consider the representation of the petitioner and pass orders thereon.
5.Taking note of the communication of the District Collector, Sivagangai/first respondent herein dated 25.11.2015, the respondents concerned is directed to consider the representation of the petitioner, dated 20.11.2015 followed by another representation, dated 24.2.2016 and to pass appropriate orders on the same in accordance with law within a period of one month from the date of receipt of a copy of this order, if there is no other legal impediment to do so.
6.With the above direction, the Writ Petition stands disposed of. Consequently, connected Miscellaneous Petition is closed. No costs.
