Heard Mr C. K. Rai, learned counsel for the petitioner, Mr Rajneesh Sharma, learned standing counsel for the respondents-State and perused the record.
Learned Counsel for the petitioner states that the petitioner is ready and willing to deposit the amount due against him towards loan in easy instalments but neither her objection has been decided nor actual statement of account has been provided to the petitioner.
Learned counsel for the Bank has no objection in accepting the amount in easy instalments.
Accordingly, this Court fixes four equal monthly instalments for the petitioner. The first instalment will become payable on 20th of June, 2019 and the rest three instalments will be paid by the petitioner on 20th day of each succeeding month.
In case, the petitioner deposits the amount in instalments as stated above, no coercive measures may be taken against the petitioner. Failure to deposit any instalment within time as stated above will leave it open to the respondents to proceed in accordance with law.
It is further directed that after deposit of the first installment the Bank shall provide actual statement of account to the petitioner as demanded by the petitioner.
With the aforesaid observations, the writ petition stands disposed of. No costs.
