This petition has been filed by the petitioner with a prayer that suitable direction may be issued to the authority concerned for ensuring fair investigation of case crime no. 314 of 2018, under Section 376 PC, P.S. Shahganj, District Agra.
The prayer made in the writ petition is only for fair investigation. However, it is not being disputed that one of the accused Manoj Sharma has filed writ petition before this Court being Criminal Misc. Writ Petition No. 35419 of 2018, pertains to same case crime number which was disposed of finally on 6.12.2018 with the direction till the submission of police report under Section 173(2) Cr.P.C. the petitioner in that case Manoj Sharma will not be arrested. The order further contains that the direction in the said case, however, the petitioner shall participate and cooperate with the investigation and police authority shall conclude the investigation within three months from the date of production of a certified copy of this order. The order is dated 6.12.2018, in view of the order already passed directing the police authority to complete the investigation within three months. No further direction with regard to the police protection is required to be passed and the present writ petition is misconceived.
The present writ petition is dismissed at this stage.
