1. Upon hearing learned counsel appearing for the petitioner Mr. Shalin Mehta and learned Government Pleader Mr.Prakash Jani, it appears that SLP (Civil) No.13619-13620 of 2012 has been entertained by the Apex Court against the orders passed by learned Single Judge as well as Division Bench and notice has been issued. Under these circumstances, we find that the present proceedings may not be required to be continued further but appropriate liberty could be reserved to the petitioner to revive the present proceedings after appropriate orders are passed by the Apex Court.
2. Mr.
Mehta, learned counsel appearing for the petitioner, voiced the grievance that there may not be harassment to the members of the petitioner Union who are working as daily wagers, may be on the ground of withholding of wages for non-resumption of duty. Mr. Jani, learned Government Pleader, in view of the aforesaid apprehension on the part of the petitioner, has declared before the Court that interim arrangement, so made pending the present proceedings, shall continue until the Apex Court concludes the issue.
3. Under the these circumstances, present proceedings are disposed of with a liberty to the petitioner to revive the proceedings after appropriate orders are passed by the Apex Court. It is also observed that the respondents shall abide by the declaration made by the learned Government Pleader for the interim arrangement as recorded hereinabove.
