Mr.M.C.Bhatt states that he had filed the present petition to challenge the proposed development plan prepared by the Vadodara Urban Developement Authority But during the pendency of this petition, the Government of Gujarat has sanctioned and finalised the said development plan and it has come into operation Therefore, in view of the said circumstances the petitioner will have to challenge the sanctioned development plan. Therefore, petitioner seeks leave to withdraw this petition with a liberty to file a fresh petition to challenge finally sanctioned development plan. Leave granted. Petitioner is allowed to withdraw the petition withdraw the petition with a liberty to file a fresh petition to challenge the validity and legality of the sanctined development plan approved by the State Government. Petition is disposed of with no order as to costs.
