Rule.
The present Civil Applications have been filed by the Applicant - ONGC for condonation of delay of 24 days caused in filing the First Appeal (Stamp) Numbers on the grounds stated in the Applications inter alia that after the copy was received and the decision was taken, delay has been caused.
Heard learned Senior Counsel Shri R.R.Marshal appearing with learned Advocate Shri Adil Mirza for the Applicant and learned Advocate Shri. K.M.Sheth for Opponent No.3 / Original Claimant and learned AGP Shri. Devang Dave appearing for Opponent Nos. 1 and 2.
Having heard learned Advocates for the parties and having considered the submissions, the present Civil Applications for condonation of delay deserves to be allowed as sufficient cause can be said to have been made out. The Hon'ble Apex Court in catena of judicial pronouncements has laid down the guidelines with regard to approach in such matters of condonation of delay, including the observations made by the Hon'ble Apex Court in case of (2005) 3 SCC 752.
Therefore, sufficient cause is made out for condonation of delay and the present Civil Applications deserve to be allowed and accordingly stands allowed. Delay is condoned. Rule is made absolute.
