"The learned Additional Government Pleader states that the present petition is filed by the petitioner to challenge the election held on 22.1.94. Under the statute the term of elected member is only three years and that period is now over and a fresh election have also taken place and hence the present petition has become infractuous. Learned advocate Mr.Oza for the petitioner states that he hasno instruction on this point but in view of the statement made by the learned A.G.P petition is disposed of as it has become infructuous. Petition is disposed of with no order as to costes. Rule is discharged."
