1.Heard learned counsel for the applicant.
2.The grievance voiced by the petitioner in this Criminal Revision Application is that the learned Judge, by the impugned order, has refused to deliver the muddamal without hearing the complainant. The petitioner has failed to serve the complainant in this Revision Application.
3.Be that as it may, the order of the learned Sessions Judge is modified and it is directed that he, instead of himself making an order with respect to the delivery of the muddamal, shall send the matter to the Chief Judicial Magistrate, who shall proceed in the case in accordance with the provisions of section 452(3) of the Code of Criminal Procedure. This Criminal Revision Application is accordingly disposed of.
