This Civil Application is filed by the original claimants to direct the office to transfer the amount of Rs.25,000/- deposited in this Court by the appellant on September 15, 1994, to the M.A.C.Tribunal, Junagadh, in M.A.C. Petition No.12 of 1987 and Execution Application No. 28 of 1994.
At the time of filing First Appeal, the appellant deposited Rs.25,000/- in this Court as per the provision of Section 173 of the Motor Vehicles Act.
The office is directed to transmit the amount of Rs.25,000/- deposited by the appellant in First Appeal No. 2029 of 1994 in this Court, to the M.A.C.Tribunal, Junagadh, in M.A.C. Petition No.12 of 1987 and Execution Application No. 28 of 1994, immediately. The M.A.C. Tribunal, Junagadh, is directed to issue an account payee cheque for Rs.25,000/- in the name of the claimant No.1, Jigirkaur Jashwantsingh Shaikh, on proper identification. The Tribunal is also directed to invest rest of the awarded amount along with interest and costs in a nationalised bank in the name of "claimant No.1-Jigirkaur, in a fixed deposit for a period of five years. Periodical amount of interest shall be paid to the claimant No.1 as and when it becomes due. No loan, encumbrance or withdrawal in respect of the amount deposited in the fixed deposit, shall be permitted. With the aforesaid directions, this Civil Application stands disposed of.
