1.The unit, which is manufacturing Inorganic Pigment, has approached this Court, as notice dated 3.2.1997 is served under section 5 of the Environment (Protection) Act, 1986, directing the unit to stop production activities, and not to start the production activities without prior permission of the State Government.
2.Mr. Trivedi for GPCB and Mr. Rawal for the Government are submitting that from the record, it appears that the unit was found discharging effluent in the open drain through bypass. Under the circumstances, we direct the unit to deposit a sum of Rupees Ten thousand within a period of one week, and considering the affidavit which Mr. Trivedi has pointed out, we grant stay till 20.2.1997.
