1.The present appellants original plaintiffs have preferred this Appeal from Order against the judgment and order dated 19/04/1996 passed by the learned Civil Judge (S.D.), Surat, whereby the application exh.5 in Special Civil Suit No.63 of 1996 for interim injunction was rejected.
2.While admitting this Appeal from Order, this Court in Civil Application No.4455 of 1996 had directed respondents no.1 to 6 to maintain status quo in respect of the suit lands till the disposal of the Appeal or the the Suit, whichever is earlier.
3.I have heard learned counsel for the parties and have perused the relevant documents on record. In view of the facts and circumstances of the case, I am of the opinion that ends of justice would be met, if the appellants are directed to make an application for expediting the hearing of the said Suit.
4.Therefore, without entering into the merits of the matter, the appellants are directed to make an application for expediting the hearing of Special Civil Suit No.63 of 1996 pending before the learned Civil Judge (S.D.), Surat. On receipt of the said application from the appellants, the trial Court shall hear and dispose of the same as expeditiously as possible and preferably within a period of one year from the date of the application.
5.With the above observations and directions, the Appeal from Order stands disposed of. Parties are directed to maintain status quo, till the said suit is finally disposed of.
