Heard learned counsel for the petitioner and learned Standing Counsel.
In view of the order proposed to be passed, notices need not go to private respondent.
The petitioner is before this Court for a direction to the second respondent i.e. Tehsildar, Tehsil Sadar, Distt. Gorakhpur to decide the Case No.2876 of 2013-14 Computer Case No.T- 201405310312749 (Smt. Anuradha Dubey v. Surendra Dhar Dubey) under Section 34/35 of U.P. Land Revenue Act within stipulated period.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue and with the consent, the writ petition stands disposed of asking the second respondent to decide the aforesaid case in accordance with law expeditiously and preferably within three months from the date of production of certified copy of this order but certainly after giving opportunity to all the stake holders in the matter.
