Heard Sri Ramesh Kumar Shukla, learned counsel for the applicant and Sri Attrey Dutt Mishra, learned A.G.A. for the State.
This application has been filed with a prayer to expedite the S.S.T. No. 2948 of 2018 (State Vs. Jeetu and others), arising out of Case Crime no. 675 of 2018, under Sections 376, 511 & 109 I.P.C. & 3, 5 and 6 of Anaitik Deh Vyapar Nivaran Adhiniyam and Section 18 of P.O.C.S.O. Act, Police Station Kotwali, District Mathura, pending before the court of Additional Sessions Judge, Court No. 8, Mathura.
It has been argued by the learned counsel for the applicant that the accused applicant is one of the six accused who are facing trial in the present case which was initiated in the year 2018 and till date only one witness has been recorded. It is also apprised that one accused namely Jeetu is lying in jail, hence direction may be issued to the trial court for expeditious disposal of this case. He has filed the certified copy of the order sheet which shows that the case was initiated in 2018 and till today only one witness is recorded.
Learned A.G.A. has no objection if such direction is being issued.
Therefore, it is directed that court below shall make all endeavour to decide this case expeditiously preferably within a period of six months from today without permitting undue adjournments to either side, if there is no legal impediment.
With aforesaid direction, this Application under Section 482 Cr.P.C. is finally disposed of without issuing any notice to O.P. No. 2 as it is an innocuous order. If the O.P. No. 2 feels aggrieved, he may approach this Court.
