Heard learned counsel for the applicants and learned A.G.A. for the State.
The present criminal misc. Application has been filed by the applicants with the prayer to quash the entire criminal proceedings of Criminal Complaint Case No. 1298 of 2018 Digendra Singh Versus Antu Rani @ Annu and others, under Sections 452, 323 I.P.C., Police Station Bahedi, District Bareilly, pending in the court of learned Civil Judge (Junior Division)/ Judicial Magistrate, Bahedi, Bareilly as well as summoning order dated 04.08.2018 and Non bailable warrant dated 31.01.2019 passed by the learned Civil Judge (Junior Division)/ Judicial Magistrate, Bahedi, District Bareilly in Criminal Complaint Case No. 1298 of 2018 Digendra Singh Versus Antu Rani @ Annu and others, under Section 452, 323 I.P.C., Police Station Bahedi, District Bareilly, pending in the court of learned Civil Judge (Junior Division)/ Judicial Magistrate, Bahedi, Bareilly It is submitted by the learned counsel for the applicants that no offence against them is made out and the summoning order has been passed in order to harass the applicants. He pointed out certain documents and statements in support of their contention. Learned A.G.A has accepted notice on behalf of the opposite party no.1.
Issue notice to opposite party no.2 returnable within four weeks at the address given in the application.
Steps be taken within one week.
Opposite parties may file their counter affidavit within four weeks. Rejoinder affidavit may be filed within two weeks thereafter.
List thereafter.
Until further orders of this court, entire proceedings of the aforesaid case shall remain stayed against the applicants.
