The petitioner seeks modification of the transfer order on the ground that the petitioner's wife is working in District Sonbhadra as Assistant Teacher in a primary school of Basic Shiksha Parishad. He has two small kids. The petitioner who was working at Chandauli near District Varanasi has now been transferred to a far off place i.e. District Shamli. It is contended that it would not be possible for the petitioner to take care of his family while being posted at such a long distance. Submission is that the transfer is a violation of the clause 1 (Ga) and (Gha) of the transfer policy dated 29.03.2018.
Considering the said fact, without expressing any opinion as to the merits of the claim of the petitioner, a liberty is granted to the petitioner to make a request for modification of the transfer order to the respondent no.1 namely Secretary, Nagar Vikas Anubhagh-1 Government of U.P., Lucknow by filing a representation alongwith certified copy of this order within a period of three weeks from today.
On such representation being made, the respondent no.1 shall pass a reasoned and speaking order in accordance with law, preferably, within a period of six weeks, thereafter.
