The petitioner has made an application for correction, in the name of his father, as recorded in the Class 10 certificate, issued by the respondent CBSE Board on 28.05.2015. The name of the father of the petitioner, as recorded in the Class 10 certificate, issued on 28.05.2015 is S. P. Singh. The full and correct name of the father of the petitioner, is "Surendra Pal Singh". The full and correct name of the father of the petitioner, is entered in the Class 12 certificate, issued by the CBSE Board on 28.05.2017.
Sri K. K. Tiwari, learned counsel for the petitioner, submits that there is a discrepancy, in the name of the father of the petitioner as entered in the Class 10 certificate, and the Class 12 certificate, issued by the respondent CBSE Board. The discrepancy has to be rectified.
Sri Hridai Narain Pandey, learned counsel has entered appearance on behalf of respondent nos. 1 to 3 contends that the correction name in the certificate issued by the Board has to based on school records.
The petitioner shall make an application to the School (respondent no. 4), in which he had studied, before appearing in the Class 10 and Class 12 examination, to correct the name of his father in the school records and enter full name of his father.
The School (respondent no. 4) shall make necessary corrections, and forward the application of the petitioner, to the CBSE Board along with the relevant record within a period of one month from the date of receipt of a certified copy of this order. The petitioner shall make the requisite payments to the School authorities.
The CBSE Board shall carry out the necessary corrections as per law. The CBSE Board shall decide the application of the petitioner for necessary correction within a period of one month from the date of receipt of the records of the School and a certified copy of this order.
It is clarified that this Court has not gone into the veracity, of the assertions made in the writ petition nor has the claim of the petitioner been judged on merits. It is for the competent authority to do so after independent application of mind.
The writ petition is disposed of finally.
