Heard learned counsel for the applicant and learned A.G.A. for the State.
The present application under section 482 Cr.P.C. has been filed for quashing the impugned order dated 3.11.2018 passed by learned Chief Judicial Magistrate, Varanasi in Misc. Case No.530 of 2018 (Anoop Prakash Vs. Anil Kumar and others), Police Station Cannt. District- Varanasi by which application of applicant dated 5.10.2018 under Section 156(3) Cr.PC. was rejected.
Learned A.G.A. appearing for the State has submitted that the applicant has an alternative remedy to file Revision under the provision of Cr.P.C. before the Court below, which could not be disputed by the learned counsel for the applicant.
The Application U/S 482 is dismissed on the ground of alternative remedy with liberty to applicant to approach the appropriate forum, if so advised.
