COMMON JUDGEMENT
The learned Government Advocate would submit that pending appeal, the sole appellant/A3 in Crl.A.No.877 of 2007 died on 19.11.2015. He also produced a memo to that effect along with the death certificate of the appellant. Hence, Crl.A.No.877 of 2007 stands abated.
2. The learned counsel appearing for the appellant in Crl.A.No.74 of 2008 would submit that the sole appellant/A1 has already undergone the sentence and he was also released from the jail.
3. The learned Government Advocate, on instructions from Mr. S.E.Sardar, Circle Inspector, Tiruvelangadu Circle, confirms the same and he has also produced a letter sent by the Circle Inspector, Thiruvallur, received from the Superintendent of Police, Central Prison, Vellore stating that after completing the sentence, A1 released from jail on 10.10.2012.
4. In view of the above facts, the Crl.A.No.877 of 2007 is dismissed as abated and Crl.A.No.74 of 2008 is closed.
