1. At the request made by the Court I/c. Chief Officer of Bagasara Nagar Palika - respondent No.1 is present. During the course of arguments, Mr. J.T.Trivedi, learned Counsel appearing for the petitioner has pointed out that out of three women tedagars, one tedagar has been given benefit which is similar to what is prayed for by the petitioner in this petition.
2. In order to explore the possibility and to examine the matter whether, the two petitioners of this petition, who are before this Court are similarly situated or not. Mr. Parikh was requested to take instructions from the concerned authorized person of the respondent Nagar Palika, who is present as aforesaid. Mr. Parikh submitted that as the Officer is I/c. Chief Officer, it is not feasible for him to take decision right away. The respondent Nagar Palika is therefore directed to verify the said fact and respond to the same by next date of hearing. It is further made clear that this is without prejudice to rights and contentions of both the parties. To enable Mr.Parikh to explore the same and to take appropriate instructions, S.O. to 10.05.2012.
