The instant application under section 482 Cr.P.C. has been filed seeking direction to the court of Judicial Magistrate-III (First Class), District Meerut to decide the proceedings of Complaint Case No. 483 of 2018 (Old Case No. 4166 of 2014) Ankit Vohra Vs. Smt. Indrani Gupta, under section 138 of the Negotiable Instruments Act, 1881 within some stipulated time.
Learned counsel for the applicant contended that the applicant has filed the aforesaid complaint against the opposite party no.2 regarding dishonour of cheque bearing no. 010243 of Rs. 15 lacs dated 25.09.2014 issued by opposite party no.2. The statement of complainant under section 200 Cr.P.C. was recorded on 18.11.2014 and the summons were issued against the opposite party no.2 but the opposite party no.2 deliberately and intentionally avoiding to appear before the court below only with a view to linger on the proceedings of the aforesaid complaint case.
Learned Additional Government Advocate appearing on behalf of the State did not oppose the aforesaid prayer.
In view of the facts and circumstances of the case stated above, the application under section 482 Cr.P.C. is disposed of with direction to Judicial Magistrate-III (First Class), District Meerut to decide the proceedings of Complaint Case No. 483 of 2018 (Old Case No. 4166 of 2014) Ankit Vohra Vs. Smt. Indrani Gupta, under section 138 of the Negotiable Instruments Act, expeditiously, preferably within a period of three months from the date a certified copy of this order is produced before him.
