This application u/s 482 Cr.P.C. has been moved on behalf of applicant seeking the direction to conclude and decide the proceedings of Case No.295 of 2017 (Smt. Anuradha vs. Ankit Vishnoi) u/s 125 Cr.P.C., P.S.-Kotwali Auraiya, District- Auraiya, pending in the court of learned Principal Judge, Family Court, Auraiya.
Heard learned counsel for the applicant and learned A.G.A. and also perused the record.
It has been made to appear by the the counsel for the applicant that the applicant is posted in Aviation Research Centre at Assam and in connection with the proceedings of the case he has to come time to time travelling the distance of hundreds of kilometres and it takes many days to reach the court. The applicant is interested to abide by the court's order and in the expeditious disposal and adjudication of the case. The only submission made by the counsel is that some short dates may be fixed so that the enormous inconvenience of taking leave may be assuaged.
In absence of complete record and in absence of opposite party this Court is not in a position to give final direction in this regard. However, this application stands disposed of with the direction to the concerned court below that it shall, in consultation with both the parties, make an endeavour to expedite the proceedings of the case and conclude the same at the earliest, unless there is some legal impediment or unless there is any order passed by the higher court staying the proceedings of the case. The court below would also proceed to fix such dates which would not cause unnecessary inconvenience to which naturally the applicant is subjected to as aforesaid.
