Heard learned counsel for the applicant, Sri Vikas Sahai learned A.G.A. and Sri Rama Shankar Yadav who appears for the informant.
The sole ground on which this second bail application has been pressed is of the statement of P.W.-1 having been recorded in the course of trial. The record reflects that as many as 14 witnesses of fact have been shortlisted by the prosecution whose evidence is yet to be recorded. The statement of P.W. 1 as recorded does not throw up any material contradictions warranting the enlargement of the applicant on bail. The submission of learned counsel for the applicant that the first information report was belatedly registered 11 hours after the incident, is noticed only to be rejected as that fact is not a new circumstance and was in existence even at the time when the first bail application came to be heard.
The present bail application is consequently rejected.
