Heard learned counsel for the petitioner, Sri Wasim Masood, learned counsel for the respondent nos. 2 and 3 learned Standing Counsel for the State .
The petitioner herein seeks for execution of the recovery certificate dated 17.6.2020 issued by the Secretary, Uttar Pradesh Real Estate Regulatory Authority, Gautam Budh Nagar.
It is contended that no appeal has been filed by the respondent no. 5/Promoter to challenge the decision of RERA fixing his liability to repay the petitioner/allottee.
In the said scenario, without entering into the merits of claim of the petitioner, the writ petition is being disposed of with the direction to the District Magistrate, Gautam Budh Nagar to execute the recovery certificate dated 17.6.2020 to its logical end, as expeditiously as possible, preferably, within a period of two months from the date of receipt of copy of this order.
