Heard Sri Anil Kumar Mishra learned counsel for the petitioner, Sri Azad Rai learned counsel for the Gaon Sabha and the learned Standing Counsel.
It appears that an application which was filed under Section 33/39 of the Land Revenue Act was decided on 20.7.2009. This order was got recalled by the petitioner on 22.10.2020.
Grievance of the petitioner is that thereafter the application was pending and a prayer therefore has been made that the case be decided within a stipulated period of time.
Learned Standing Counsel states that all endeavour shall be made to decide the case.
Under such circumstances, without going into the merits of the case, it is being directed that the Case No. 7140 of 2020, Computerized Case No. T202002030207140 (Shiv Dulari widow Rajendra Prasad vs. Gaon Sabha) under Section 38(2) of the U.P. Revenue Code, 2006,unless there is any legal impediment, be decided within a period of three months from the date of presentation of a copy of this order. Copy of this order would be duly certified by the petitioner's counsel.
With these observations the writ petition is disposed of.
The Filing Section may also correct the name of the counsel who had filed the writ petition in its record. Erroneously, it appears that the name of Sri Ram Ji Gupta has been shown in the cause list.
