Ms Pooja, learned counsel for the petitioners and Sri Amit Sinha, learned AGA for the State.
This writ petition has been filed by the petitioners seeking quashment of FIR dated 2.10.2020 in respect of Crime No.0170 of 2020 for the offence under Sections 363, 366, 352, 504 of IPC, Police Station Phoolpur, District Chandauli.
Counsel for the petitioners submits that the petitioners have performed marriage on 10.12.2019 and the said marriage has also been registered. She submits that as both the petitioners are major, they have every right to enjoy their married life. On instructions, she prays for withdrawal of the writ petition with liberty to file anticipatory bail application before appropriate Court on behalf of petitioner no.2. She further submits that in the eventuality of filing any such application by petitioner no.2, the competent Court be directed to decide the same expeditiously in accordance with law considering all aspects of the case.
Petitioner is permitted to withdraw this petition with the aforesaid liberty.
Needless to state that in the eventuality of filing any such application by petitioner no.2, the competent Court shall decide the same in accordance with law expeditiously considering all the aspects of the case, including factum of marriage.
The party shall file a computer generated copy of this order downloaded from the official website of High Court Allahabad, self-attested by the petitioner, along with a self-attested identify proof of the said person (s) (preferably Aadhar Card).
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
Petition is dismissed as withdrawn.
