The writ petition has been filed for quashing the F.I.R. dated 23.12.2018, registered as Case Crime No.725 of 2018, under Sections 498A, 304B, IPC and 3/4 Dowry Prohibition Act, P.s. Sarnath, district Varanasi.
In the F.I.R. the allegation has been made that daughter of the informant was married to Anil Verma on 11.7.2018. Although at the time of marriage sufficient dowry was given but the accused were demanding Rs.5-00 lac for establishing a business. thereafter they were also demanding four wheeler Bolero vehicle. On 21.11.2018 they have assaulted the daughter of the informant and burnt her due to which she died on 22.12.2018 In the present case according to the F.I.R. marriage took place on 11.7.2018 and death took place on 22.12.2018 due to burn injury then prima facie F.I.R. discloses a cognizable offence and it is not liable to be quashed.
However, if the petitioner surrenders and applies for bail before the court below, then the same shall be considered and decided in accordance with law expeditiously.
The writ petition is disposed of.
