Heard Sri Ajay Kumar Mishra, learned counsel for the revisionist, learned A.G.A. for the State, Sri Jayant Kumar, learned counsel for O.P. No. 2,3 and 4 and perused the record.
This criminal revision has been filed with a prayer to quash the judgment and order dated 15.10.2019 passed by learned Principal Judge, Family Court, Chitrakoot in Crl. Misc. Case No. 51 of 2011 (Upma Devi and others Vs. Anil Kumar), under section 125 Cr.P.C., P.S. Bargarh, District Chitrakoot.
From the perusal of the record it appears that the present matter was sent to the Mediation Centre of this Court on 18.11.2019 and according to the report of Mediation Centre dated 1.2.2020 it transpires that mediation between the parties was failed as both the parties were not willing for mediation.
Considering the report of the mediation centre as well as non compliance of the order passed by the Principal Judge, Family Court, Chitrakoot awarding the maintenance allowance under section 125 Cr.P.C., at this stage no useful purpose will be served to keep the matter pending before this Court, consequently, the interim order passed in the present case is hereby vacated and criminal revision is hereby also dismissed.
Office is directed to send a copy of this order to the court below for necessary action.
