When the mother of the petitioner died, the petitioner moved an application for the mutation of his name under Section 174 of the Uttar Pradesh Zamindari Abolition and Land Reforms Act, 1950, and an order was passed in his favour on 29.9.2006. Thereafter, when the father of the petitioner got his name mutated and the petitioner unsuccessfully contested the matter then an appeal was filed by him and on 12.3.2013, the matter was remanded back to the Mutation Court. In the meantime, the father of the petitioner sold the property on 31.12.2011 to the predecessor in interest of the respondents no. 8/1, 8/2 and 8/3.
The petitioner is now aggrieved by the fact that the respondents no. 8/1, 8/2 and 8/3 are demolishing the structures made on the plots in question. If that is the case, then the petitioner can move an application before the Revisional Court for a direction to the respondents no. 8/1, 8/2 and 8/3 that they may not demolish the structure existing over the plot in question.
If the application is moved within a period of one month from today, orders shall be passed thereon within the next one month of the date of production of a certified copy of this order.
The writ petition is disposed of.
For a period of two months or till the passing of the order by the Revisional Court, whichever is earlier, status quo as of today shall be maintained.
